PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE BRIICK .
These provisions govern your use of the Briick platform (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and Conditions, which constitute a legally binding contract between you and Briick.com Pty Ltd ("Briick," "we," "us," or "our").
We may update or modify these Terms from time to time to reflect changes in our business, legal obligations, or improvements to our service. If we make significant changes, we will provide you with reasonable notice (such as via email or a notice on the Platform) before the changes take effect. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you may discontinue using the Platform before the changes apply.

1. Definitions
Unless the context otherwise requires, the following words have the meaning set out below:
Briick (or The Platform): Refers to Briick.com Pty Ltd (trading as "Briick"), the digital platform, and the services it provide
Briick Loyalty Member (or Service Requester): Any individual or organisation who uses the Platform to submit maintenance or service requests. This typically includes property managers, real estate agents, landlords, or other parties responsible for coordinating property services.
Briick Subscriber (or Service Provider): Any tradesperson, property service provider, or real estate professional who has subscribed to a Briick plan (Starter, Briick+, Briick Pro, or Legacy subscriptions). A Service Provider may also use the Platform to request services from other Service Providers.
Data: Any data inputted into the Platform by you or on your behalf, including personal information, images, and videos.
Fixed Term Subscription Plan: Refers to the monthly or annual payment arrangement set by Briick and agreed to be paid by a Briick Subscriber to Briick.
Legacy Subscriptions: Subscription plans managed at Briick’s discretion, which may be transitioned to current membership plans with reasonable notice.
Platform Fees: Refers to any fees charged by Briick for the use of the Platform. This includes subscription fees, service fees applied to work orders completed through the Platform, and success fees, as detailed in these Terms.
Privacy Policy: Our privacy policy, available on the Platform.
Profile/Business Profile/Pro Business Profile Page: A Service Provider's profile page on the Platform, where they showcase their services and contact information. This functions as a standalone webpage.
Reward Program: A points-based reward system where Service Requesters earn points for completed and paid maintenance and repairs jobs/work orders and can redeem rewards once thresholds are met.
Briick Collect: Refers to the automated follow-up and reminder service provided by Briick to assist Service Providers in managing unpaid or outstanding invoices. Briick Collect sends scheduled payment reminders to clients on behalf of the Service Provider after a work order is marked as complete. The availability and usage limits of Briick Collect depend on the Service Provider’s subscription tier. This service does not constitute formal debt collection or financial enforcement.
Services: The facilitation services provided by Briick through the Platform, connecting Service Requesters with Service Providers.
Terms: These Terms and Conditions as they may be updated from time to time.
User: All individuals and entities using the Briick Platform, including Service Requesters and Service Providers.
WHS/OHS Laws: Refers to workplace health and safety or occupational health and safety laws and regulations applicable in Australia (Work Health and Safety Act 2011 (Cth) and state/territory equivalents) and New Zealand (Health and Safety at Work Act 2015), as well as any other relevant safety or "saving" laws that apply to the performance of trade services.
2. Acceptance of Terms
2.1 Summary: These Terms formally set out your obligations relating to accessing and using the Services and the Briick Platform. We strive to create a positive experience and expect all Users to act with integrity. While we do not guarantee the behaviour of Users or the performance of any Service Providers, if someone breaches our standards and we are notified, we will take appropriate steps to address the issue, which may include suspending or removing their access to the Platform.
2.2 Acceptance and Changes: By registering on, accessing, or using the Briick Platform, you agree to these Terms. We may update them periodically to reflect business changes, legal requirements, or service improvements. If significant changes are made, we will provide at least 14 days' notice via email or by posting a notice on our Platform before they take effect. Your continued use of the Services after the effective date constitutes your acceptance of the changes. These Terms were last updated on June 5, 2025, and apply to all Users of Briick.
2.3 Use of Reward Program: Access to and participation in the Briick Reward Program is optional and subject to eligibility. Briick reserves the right to modify or discontinue the program at any time without notice.
3. Eligibility and Legal Capacity
3.1 Acceptance: To access and use the Briick Platform, including receiving job referrals or participating in the rewards program, you must first accept these Terms. You accept the Terms by:
Creating a Briick profile; and
Clicking to accept or agree to the Terms when prompted.
You may not use the Briick Platform if:
You are not legally able to enter into a binding agreement; or
You are otherwise prohibited from entering into contracts under applicable law.
If either of the above applies to you, you must not use the Briick Platform. By accepting these Terms, you confirm that you have read and understood them, that the Terms are fair and reasonable, and that you are entering into this agreement willingly and without pressure. If you are unsure about any part of these Terms, you should seek independent legal advice.
3.2 Eligibility Requirements: To be eligible to use our Platform, you must:
Be eighteen (18) years of age or older.
Have the right, authority, and capacity to enter into these Terms and commit to abide by all of the Terms.
Have provided complete, accurate, and current personal information and other account details when registering with us.
If you are a Service Requester, have the authority to act on behalf of the property owner, tenant, or relevant entity in relation to the maintenance request.
If you are a Service Provider, you must hold all legally required insurance, certifications, and/or licenses necessary to perform your services in Australia or New Zealand, as applicable, including but not limited to public liability insurance, professional indemnity insurance (if relevant to your trade), and where applicable, workers' compensation insurance for any employees you engage. You are solely responsible for ensuring you comply with all relevant WHS/OHS Laws and any other safety or "saving" laws applicable to your trade and work practices. Briick may verify these credentials and may suspend or remove accounts that fail to comply.
Service Providers must submit proof of required insurance (public liability, professional indemnity if relevant, and workers’ compensation if applicable) to Briick at registration and annually thereafter. Failure to provide valid documentation may result in suspension or removal from the Platform.
3.3 No Principal Contractor Relationship : Briick is a digital platform and marketplace that facilitates invoicing and payment communication between Service Providers and Service Requesters. As a Service Provider using Briick, you acknowledge and agree that:
Briick acts solely as a facilitator for invoicing and payment tracking in relation to work orders. Briick is not a principal contractor, employer, or subcontractor, nor does it engage Service Providers to perform services on its behalf.
The contractual relationship for the delivery of maintenance or repair services exists only directly between you (the Service Provider) and the Service Requester (e.g., property manager, landlord, or similar party).
Briick issues invoices to the Service Requester on behalf of the Service Provider as part of the platform’s service facilitation. Briick collects funds from Service Requesters and facilitates the disbursement to Service Providers, less applicable fees. Briick does not operate a client trust account and does not hold funds on behalf of Users in a fiduciary capacity. Once payment is confirmed, the net amount—less applicable service or success fees—is released to the Service Provider.
You, as the Service Provider, remain solely responsible for the performance and delivery of all services, including but not limited to service quality, timelines, warranties, and any liabilities arising from the job.
You are solely responsible for your own tax obligations (including GST if applicable), superannuation, insurance (e.g., public liability, professional indemnity, workers' compensation where required for your own employees or subcontractors), and all other compliance obligations under the laws of your operating country (Australia or New Zealand), including all WHS/OHS Laws and any other relevant safety or "saving" laws.
Your relationship with Briick is that of an independent user of the Platform. Nothing in these Terms creates an employment, agency, partnership, joint venture, or principal-contractor relationship between you and Briick.
Briick does not provide or guarantee the provision of any services and is not liable for any performance, defect, or safety issues arising from those services.
Briick Collect, if selected, enables Briick to send automated payment reminders to the Service Requester on your behalf. This service is only applied to jobs where you have expressly activated the feature. For all other jobs, you are solely responsible for managing payment collection.
Nothing in these Terms shall be construed as Briick exercising control over how Service Providers perform their work, set their prices, or manage their business. Service Providers are solely responsible for determining how to carry out their services. Briick does not direct, supervise, or control Service Providers’ work.
4. Booking System and Facilitation Role
4.1 Job Request Process: To request maintenance services through Briick, Service Requesters has to sign up to became a loyalty member on Briick. Service Requesters are welcome to nominate a preferred Service Provider. If their preferred provider isn’t available, Briick may suggest a suitable alternative. When a job is submitted, Briick will share the relevant details such as job location, timing, scope of work, and property access contact details (e.g., tenant contact number) with suitable Service Providers on the Platform. Submitting false or speculative jobs is prohibited. Misuse may result in suspension or loss of Platform access. Briick may update or change Platform features at any time, at its sole discretion.
4.2 Briick's Facilitation Role: Briick operates solely as a third-party facilitator. Briick does not guarantee the availability, pricing, or performance of any Service Provider and is explicitly NOT a party to the contract for services between Users. Once quotes are submitted and a Service Provider is selected, Briick’s system supports scheduling and coordination of the work order. While Briick facilitates the booking process, we do not guarantee that the selected Service Provider will accept the job, nor that the Service Requester will proceed with the selected Service Provider.
4.3 Quality Focus: Briick prioritises quality over quantity. Our marketplace is designed for professionals who take pride in their craft and want to grow a reputation for dependable, high-quality work. We do not cater to price-sensitive or bargain-hunting clients.
4.4 Direct Contractual Relationship: All Briick Users acknowledge that any contractual relationship, negotiation, or agreement for services performed is solely and directly between the Service Requester and the Service Provider. Briick is not a party to such agreements, nor is it responsible for their enforcement, terms, or outcomes. Briick recommends that Service Requesters and Service Providers use a written contract for each job. Briick will provide a template agreement for Users to adopt, but Users are solely responsible for finalising and executing their own contracts. Briick is not a party to any contract between Users.
4.5 User Independence: Service Providers are independent professionals and are not employees, agents, partners, or joint venturers of Briick. As such, Briick is not liable for their behaviour, performance, acts, or omissions. However, if a User has concerns about the conduct of another User, they may contact us. We will review the matter and, where appropriate, take further action, which may include raising the issue with the relevant User or removing them from the Briick Platform.
4.6 Account Security: All Users, including Service Providers, are strictly prohibited from sharing their password with any third party and are responsible for maintaining its confidentiality. Briick will never request passwords or other sensitive information via email. If any User suspects unauthorised use of their account or access to their password, Briick recommends that they immediately change their password and notify us. Users are responsible for all unauthorised use of their service account by any party who gains access to it, whether directly or indirectly.
4.7 Account Closure: Users may close their service account at any time; however, they will remain responsible for any obligations related to their account even after its closure. Certain sections of these Terms and Conditions, including Copyright and Intellectual Property, Disclaimers, Exclusions and Limitation of Liability, and Disputes, will continue to apply even after their account has been closed.
5. Maintenance Services and User Obligations
5.1 Platform as Facilitator: Briick operates the Platform solely as a third-party facilitator for Maintenance Services, providing a system for Service Requesters to connect with independent tradespeople and service providers ("Service Providers"). Briick is not acting as an agent, broker, principal contractor, or employer for either the Service Requester or the Service Provider. Any engagement with a Service Provider through the Briick Platform is at the Service Requester's own discretion and risk. While we use our best efforts to monitor the quality and professionalism of Service Providers on our Platform, Briick does not guarantee the safety, condition, accuracy, quality, or outcome of the services provided by Service Providers. Any concerns about the conduct or performance of a Service Provider should be reported to Briick, and we will review the matter and follow up where appropriate. All job bookings are subject to Service Provider availability. Service Providers warrant that all services supplied comply with the Australian Consumer Law (ACL) or New Zealand Consumer Guarantees Act (CGA), as applicable. Briick is not responsible for ensuring compliance with these laws by Service Providers.
5.2 Right to Use: Subject to compliance with these Terms, Briick grants Users a non-exclusive, revocable, and non-transferable right to access and use the Platform solely for the purpose of accessing and using the Services as intended.
5.3 Restrictions on Use: When using the Services, Users agree and acknowledge that:
All requests, quotations, or communications made through Briick must be made in good faith.
All requests, communications, emails, and correspondence made through or on the Platform, or directed to Users, must not contain offensive, insulting, defamatory, or inappropriate language. Briick reserves the right to determine what constitutes such language and may take action against the responsible User, including suspension, deactivation, or permanent banning from the site.
Users may not use the Platform or Services for any unlawful purpose.
Users must not damage, interfere with, or harm the Platform or Services, or any network, or system underlying or connected to them, or attempt to do so.
Users may not use a robot, spider, scraper, or other automated means to access or use the Platform, Services, or information featured on the Platform for any purpose.
All tax obligations (including income tax, GST/VAT) are the sole responsibility of the respective Users (Service Providers and Service Requesters) as determined by applicable tax laws in Australia and New Zealand.
5.4 Account Maintenance: To access the Briick service, Users must maintain an active Briick account.
5.5 Service Provider Performance and Reviews: Service Providers acknowledge that eligibility for future job referrals may be impacted by performance history, including the quality of work and reviews received on prior Briick jobs. Negative reviews may limit a Service Provider’s ability to be selected for new job opportunities. To mitigate risks related to tradie quality, Service Requesters are encouraged to provide clear feedback and ratings for each job completed. Briick may use this feedback to maintain a quality marketplace and may blacklist or scorecard low-performing Service Providers.
5.6 Quote Requirements: Service Providers agree to provide quotes that are accurate, complete, and include all relevant service details and payment terms. Quotes must be submitted to Briick and in local currency (AUD or NZD). If GST-registered, you must clearly include GST in your pricing.
5.7 Job Completion and Reassignment: If you are unable to complete a job due to availability, resources, or skills, you agree to notify both Briick and the Service Requester promptly. Jobs must not be reassigned without prior approval from Briick and the Service Requester.
5.8 Fee Evasion: You agree that you will not attempt to avoid paying agreed fees to Briick. Briick reserves the right to suspend or terminate your account for any form of fee evasion or misuse.
5.9 Review Manipulation: You may not threaten, pressure, or coerce any Briick team member or User into changing a review. If you believe a review is unfair or defamatory, contact Briick at hello@briick.com. We may investigate and take appropriate action.
5.10 Legacy Subscriptions: If you have a Briick (or Your Property Buddies) Legacy Subscription, you must pay the fees agreed upon in your direct communication with Briick, whether by email or contract. This may include success fees where applicable. Legacy subscriptions and their durations are at the discretion of Briick.
5.11 Automatic Renewal: You acknowledge that your Briick subscription will automatically renew at the end of the initial term for the same renewal period unless you cancel it before the renewal date. We will send a renewal reminder at least 7 days prior to the renewal date. You may cancel your prepaid subscription through the Briick "Settings" section or by emailing hello@briick.com. Briick will not be liable for any losses or costs incurred due to your failure to update or cancel your paid subscription before the renewal date. Briick Subscriptions must be paid monthly in advance for the duration of the subscription term and any renewal term.
5.12 Early Termination Fee: If you cancel your Briick Subscription early, we may charge you an early termination fee equal to the subscription fees payable for the remainder of the term. This fee will be due immediately upon cancellation.
5.13 Non-Refundable Subscriptions: All Subscription Plans are non-refundable once paid. Unless cancelled before the renewal date, subscriptions automatically renew for the same term. It is the User's responsibility to cancel in advance if they do not wish to be charged. Briick is not liable for missed cancellation requests.
5.14 Debt Recovery: Briick reserves the right to take action against you to recover outstanding debt, including engaging debt collection agents, registering the debt with a credit bureau such as Equifax, and/or instituting legal proceedings against you to recover overdue payments. You are liable for all expenses (including but not limited to court costs, legal fees, collection agency fees, and a $95.00 administrative fee) that Briick incurs in collecting that debt.
5.15 Briick Fees as Business Expense: All fees charged by Briick are to be considered a cost of doing business and are not to be passed on directly to Service Requesters through the quote as an itemised charge. Briick is a means of marketing a business and should be treated as such in regards to fees. Directly charging the fee through an invoice may result in the Service Provider's account being terminated.
5.16 Post-Termination Fees: In the event that you terminate your Briick account, all fees remain payable. This applies to Success Fees that are generated after account termination but are the result of jobs served through Briick before the account was terminated.
5.17 Credit/Debit Card Services: Service Providers are required to provide a valid credit or debit card for subscription payments. You can contact us by email at hello@briick.com regarding any credit or debit card issues or questions. All fees are in Australian dollars and agreed at registration. Subscriptions must be paid in advance for the initial term or any renewal term. Payment will be automatically processed on the renewal date of your subscription. If payment cannot be processed, we will attempt to retry once. If the second attempt also fails, your membership will be suspended, and your profile will be closed. 5.18 Invoice Payment Terms: All Users agree to pay Briick invoices, subscription charges, and applicable fees within the payment terms stated on the invoice. If your account has an overdue invoice, your access to the Platform may be automatically restricted. Past due balances may incur a finance charge of 1.5% per month. You agree to receive all invoices via email, sent to the address you have provided. It is your responsibility to ensure that this email address is valid and functioning correctly.
6. Platform Fees and Payouts
For completed work orders, Briick prepares and issues invoices to the Service Requester on behalf of the Service Provider as part of its platform services. Payment is collected by Briick in its capacity as a disclosed agent for the Service Provider. Once the Service Requester confirms completion and payment is received, Briick facilitates the disbursement of the net amount to the Service Provider, less any applicable platform fees.
6.1 Fraud Prevention: While Briick has systems in place to reduce the risk of credit and debit card fraud. Briick is not liable for any loss resulting from fraudulent activity initiated by third parties. In some cases, legitimate transactions may be blocked by our fraud prevention systems. If this occurs, an alternative payment method may be required.
6.2 Authorised Registration: You must have proper authority to create a Briick account on behalf of a company, business, or individual. Unauthorised registration is considered fraudulent behaviour and may lead to fines, penalties, or referral to law enforcement.
6.3 Payment Processing: For subscription payments, Briick uses Stripe to securely process your credit or debit card details. By using the Platform, you authorise Briick to charge your card via Stripe for applicable fees. Fees will be charged on the invoice due date, and failed transactions may be retried at a later time.
6.4 Unpaid Invoices: Unpaid subscription or platform fees may result in restricted account access or service suspension. If required, Briick reserves the right to refer unpaid balances to a debt collection agency, and any recovery costs may be passed on to the User.
6.5 Service Fee: Briick charges a service fee on every completed and paid work order processed through the Platform. This fee covers the core features you use on Briick, including issuing invoices on your behalf, managing payment collection from the Service Requester, tracking payment status, and providing tools such as your job board, account dashboard, and support services. The service fee is calculated as a percentage of the total job value and is automatically deducted from the amount paid to the Service Provider once the job is marked complete and paid. For work orders with a value of $5,000 or less, the service fee is 2.9%. For work orders above $5,000, the fee is reduced to 2.2%. These fees are not invoiced separately, they are reflected in the transaction summary available in your account.
6.6 Success Fee: A success fee applies when a Service Provider wins work from a Briick Service Requester (such as a Property Manager or landlord) who was introduced through Briick. The success fee is charged only when the Service Provider accepts the job, completes the work, and payment is received. The fee is 8% of the total job value and is automatically deducted at the time of payout, in addition to the standard service fee.
Service Providers will not be charged a success fee for work from a Service Requester they personally invited to Briick, or where the Service Requester registered via the Service Provider’s invitation link and joined the Briick Loyalty Program as a result. Meaning that unless this invitation can be verified through platform records, any job received from a Briick-connected Service Requester will be subject to the 8% success fee.
6.7 Payment Issues: For any credit or debit card issues related to Briick's fees, Users agree to immediately contact us at hello@briick.com.
7. Provision of Information
7.1 Contact Consent: By providing your contact information to Briick, you expressly consent to being contacted by us using any of the contact details you have provided. For more information on how we use your data, please refer to our Privacy Policy.
7.2 Accuracy of Information and Indemnification: You agree that all information you provide will be accurate, current, and correct. If you provide any information that is inaccurate, untrue, or false—or if Briick has reasonable grounds to suspect so—Briick reserves the right to deny you access to the Briick Services or Platform, either in part or in full, now or in the future. Providing false information, including but not limited to name, phone number, address, or email address, is considered fraudulent and a serious violation. Such actions may cause financial and reputational harm to Briick or other Users, leading to wasted time, effort, and expenses in responding to and addressing false information and requests. Additionally, it may result in regulatory fines and penalties. Accordingly, if you knowingly submit false information—including using another person's details, a fictitious name, or random contact information—you agree to fully indemnify and be liable to Briick and any affected User for any resulting loss, including reasonable legal fees, costs, and expenses.
7.3 Data Protection & Compliance: Briick collects and processes personal data in accordance with the Australian Privacy Act 1988 (Cth), the New Zealand Privacy Act 2020, and GDPR where applicable. Users consent to data processing for service facilitation and marketing. For more details, see our Privacy Policy.
8. Intellectual Property
8.1 Licence to Use Platform: We grant you a limited, revocable, and non-exclusive licence to use the Platform in accordance with these Terms.
8.2 Ownership of Intellectual Property: You agree that title to, and all intellectual property rights in, the Platform and all text, reviews, feedback, graphics, logos, button icons, images, audio clips, software, mobile applications, and all underlying systems are the property of Briick (and/or our licensors). Nothing in these Terms transfers that ownership, and you agree not to dispute our ownership of such items at any time.
8.3 User Data Licence: You grant us a worldwide, non-exclusive, fully paid-up, transferable, perpetual, irrevocable, sub-licensable, licence to use, store, copy, modify, translate, make available, and communicate the Data for any purpose connected with our business, including the exercise of our rights and performance of our obligations under these Terms, providing the Platform and Services, and for marketing purposes.
8.4 Restrictions on Reproduction: You may not, without our prior written permission, in any form or by any means:
Adopt, reproduce, copy, store, distribute, print, display, perform, publish, or create derivative works from any part of the Platform or Mobile Application; or
Commercialise, copy, or on-sell any information or items obtained from any part of the Platform or Mobile Application except to the extent permitted by these Terms.
8.5 Copyright and Intellectual Property Protection: The entire contents and design of the Briick Platform, including all text, images, and audio and video files, are proprietary to us and protected by copyright laws. Your use of the Briick Platform is for your personal, non-commercial use. You may not reproduce, modify, copy, distribute, transmit, communicate, display, publish, or use any material contained in the Briick Platform without our express prior written permission. You acknowledge that any breach by you of this paragraph may cause damage to us which cannot adequately be remedied by damages, and that if you breach or act in a way which threatens to breach this paragraph, we may seek injunctive relief against you.
8.6 User Contributions: If, during your use of the Briick Platform, you share or contribute any ideas, feedback, methods, or improvements—and they are not already owned by us—you grant Briick a worldwide, non-exclusive, fully paid-up, transferable, perpetual, and irrevocable licence to use them in any way related to the development and operation of the Platform. This includes any know-how or techniques discovered or applied by Briick while providing the service.
9. Disclaimers
9.1 General Disclaimer: You expressly understand and agree that your use of the Services is at your sole risk. The Platform and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Briick disclaims and excludes all implied conditions or warranties, including, any warranties of merchantability, fitness for a particular purpose, and non-infringement. You are responsible for taking all precautions you believe necessary or advisable to protect you against any claim, damage, loss, or hazard that may arise by virtue of your use of the Briick Platform. Neither we nor anyone else involved in creating, producing, or delivering the Briick Platform, our newsletters, or the materials contained therein assumes any liability or responsibility for the accuracy, completeness, or usefulness of any information provided therein, nor, to the extent permitted by law, shall any of them be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Briick Platform. You must not use any means of automatically searching or mining data from the Briick Platform or in any way interfere or attempt to interfere with the proper operation of the Briick Platform. You agree not to take any action that imposes an unreasonable burden on our infrastructure or otherwise tampers or interferes with the Briick Platform, our systems or data, or those of any third party via the Briick Platform.
9.2 Service Availability and Information Accuracy: Briick does not warrant that:
The Platform or Services provided will be uninterrupted, timely, secure, or error-free; or
That any information (including Feedback) provided on the Platform is error-free or reliable.
9.3 Networks: You acknowledge that the Briick Services and the Platform are provided over the Internet and mobile networks. We do not accept any responsibility for any inability to use the Platform, or any Services, that arises from an issue between you and your network or communication provider.
9.4 Advertisements: Responsibility for the content of advertisements appearing on the Platform (including hyperlinks to advertisers' own websites) rests solely with the advertisers. The placement of such advertisements on the Platform does not constitute Briick's recommendation or endorsement of the advertised product or service. Each advertiser is solely responsible for any representation made in connection with its advertisement.
9.5 User Vetting and Verification: While Briick conducts checks and vetting processes before accepting Users onto the Platform, we do not guarantee and cannot independently verify on an ongoing basis that all Users are appropriately licensed, insured, or free from bankruptcy, civil claims, or criminal proceedings. Briick relies on the accuracy of the information provided by Users and cannot be held responsible if any information is false, misleading, or incomplete at the time of registration, during their membership, or thereafter. If we are notified by other Briick Users that a User has provided false or misleading information—such as fake documents, invalid licenses, or inaccurate insurance status—or has engaged in concerning conduct, we will take the matter seriously and may investigate, suspend, or permanently remove the User from the Platform.
9.6 User Misconduct: Briick is not responsible or liable for any misconduct by its Users, including those who register under false pretences or attempt to commit fraud. If you become aware of any User engaging in misconduct or violating our Terms and Conditions, we encourage you to inform us. Reports will be handled confidentially, and Briick will take the necessary action to protect the integrity of our marketplace from untrustworthy Users.
9.7 Australian and New Zealand Consumer Law: Nothing in these Terms excludes, restricts, or modifies rights under the Australian Consumer Law (ACL) or the New Zealand Fair Trading Act 1986 that cannot lawfully be excluded, restricted, or modified. However, as Briick is a marketplace facilitator and not the direct provider of maintenance or repair services, Users agree that any claims regarding service quality, delays, damages, or disputes related to the performance of services must be directed solely at the Service Provider (for Service Requesters) or Service Requester (for Service Providers) and not at Briick.
10. Exclusions and Limitation of Liability
10.1 Exclusion of Liability for User Interactions: To the maximum extent permitted by law, Briick is not responsible for any disputes, damages, or losses resulting from interactions or direct agreements between Users. All contracts, payments, and service agreements are made directly between Users, and Briick has no involvement, liability, or control over these agreements or the performance of services. Briick makes no warranties, representations, or guarantees and excludes all liability in relation to services provided by Service Providers, including but not limited to:
The content, safety, description, worthiness, quality, or legality of the trade services listed on the Platform.
The accuracy or truthfulness of requests or quotations.
Whether services will meet a User's requirements or expectations.
The ability of Service Providers to complete and/or Service Requesters to pay for a service or job requested.
10.2 General Limitation of Liability: To the maximum extent permitted by law, Briick excludes all liability and responsibility to you or any other person in connection with these Terms, the Services, or the Platform, regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise. Briick will not be liable for any loss or damage, whether direct or indirect, including but not limited to loss of profits, loss of data, loss of business, general or special damages, and consequential or incidental loss.
10.3 Indemnification: You agree to release, indemnify, and hold Briick harmless from and against all claims, actions, costs (including legal fees and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by Briick arising out of or in connection with:
Your failure to comply with these Terms.
Your failure to complete a transaction (as a Service Provider or Service Requester).
Your use of Briick's customer ratings (including any feedback you provide).
Any content, request, or item you submit, post, transmit, or make available through the Services.
Any dispute or claim arising from the services provided by a Service Provider to a Service Requester, or vice versa, where Briick acted solely as a facilitator.
Your failure to comply with any applicable WHS/OHS Laws or other safety regulations.
11. Cancellation and Termination
11.1 User Account Cancellation: You are entitled to cancel your User account at any time. You may cancel your account by following the prompts when you are logged into your account through the Platform. Cancellation of a Briick Subscription will not be effective until the end of the current subscription term.
11.2 Briick's Right to Terminate: We may terminate your account on written notice to you at any time without giving any reason. Such termination will be effective at the time we elect (which may be immediately).
11.3 Remedies for Breach: Without limiting any other rights and remedies available to Briick, if you breach these Terms or where Briick considers in its sole discretion it appropriate, Briick may limit your activities on the Platform, remove your match requests or account details, warn other Users of your actions, issue a warning to you, suspend or terminate your account, or refuse to provide our Services to you.
11.4 Effect of Cancellation or Termination: If your account is cancelled or terminated, all of your rights granted under these Terms will immediately come to an end (except to the extent that it is necessary for them to continue in respect of our ongoing storage of Data up to the date of permanent deletion). We are not liable for any loss following, or as a result of, cancellation or termination of your account.
12. Disputes
12.1 General: Any disputes between you and Briick will be discussed in good faith with a view to resolving the dispute. Briick may, at its sole discretion, act as a neutral facilitator in disputes between Users without assuming any liability for the outcome or the underlying services. This does not obligate Briick to mediate or resolve any dispute.
13. General Provisions
13.1 No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
13.2 Severability: If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, the part or provision is deemed to be modified to the extent required to make it valid and enforceable. If this is not possible, the provision must be treated as severed, and the remaining Terms will remain in full force.
13.3 Force Majeure: We are not liable to you for any failure to perform our obligations under these Terms if the failure is caused by circumstances beyond our reasonable control, including natural disasters, pandemics, system failures, or government restrictions.
13.4 Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any related or successor entity, including one that acquires part or all of our business.
13.5 Governing Law: These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria in relation to any dispute arising under or in connection with these Terms.
14. Legal Protections and Limitations
14.1 Safe Harbor for Copyright Content: Briick has implemented a designated agent process under the Copyright Regulations 1969 (Cth) to limit liability for certain copyright infringement claims. Notices of claimed infringement should be directed to: Email: hello@briick.com Subject: Copyright Notice
14.2 Third-Party Rights: The Indemnification and Limitation of Liability clauses in these Terms also apply to our officers, employees, contractors, and service providers. These parties may enforce these protections directly against you.
14.3 Liability Cap: To the extent permitted by law, Briick’s total liability to you for any claim under these Terms is limited to the greater of: (a) AUD $200; or (b) the total subscription fees paid by you to Briick in the 12 months prior to the event giving rise to the claim.
15. Communications and Marketing
15.1 Marketing Communications: By creating an account on the Briick Platform, you agree to receive transactional and promotional emails from us. These may include platform updates, new features, offers, or other relevant information. You can opt out of promotional emails at any time by clicking "unsubscribe" in the email or contacting us. You will continue to receive essential account-related communications even after unsubscribing.
15.2 No Professional Advice: All content on the Briick Platform (including blogs, case studies, and newsletters) is for general information only and is not legal, financial, or professional advice. You should seek independent advice before relying on any such content. We do not guarantee its completeness, accuracy, or suitability for your circumstances.
